한국의 헌법과 필리핀의 헌법

2018년 1월 1일자 경향신문 1면에는 한국과 독일의 헌법 1조 1항이 담겼고.

2면에는 세계 여러 나라의 헌법 1조를 적었다. 

'


유럽국가들이 대부분이고, 무엇보다 현대 헌법의 정수라고도 할 수 있는 르완다 헌법이 빠진 것이 좀 아쉽지만. ^^
여러 나라의 역사가 반영된 것들이라 재미있었다.


그 중에 눈에 띈 것- 필리핀의 헌법 1조.



한국 헌법과 거의 같다. 사실은 똑같다. 우리도 '인민(people)'이라고 했어야 하는데 북한이 쓰는 말이라고 해서 '국민'이 돼버린 것이니.


필리핀은 군사독재정권과의 싸움에서 한국보다 시기적으로 조금 앞섰고, 필리핀 피플파워 혁명은 한국에도 영향을 미쳤다. 필리핀 헌법은 1987년에 발효됐다. 군사독재의 경험, 그에 맞선 인민들의 싸움, 이런 것이 헌법에 그대로 반영된 것을 보니 재미있다.


(근데 사실은 나치로부터 해방된 다음에 만들어진 오스트리아 헌법도 똑같음 ㅋ)


아래는 필리핀 헌법과, 한국 헌법의 비슷한 구절을 비교해본 것.

THE 1987 CONSTITUTION

THE CONSTITUTION OF THE REPUBLIC OF THE PHILIPPINES

PREAMBLE

We, the sovereign Filipino people, imploring the aid of Almighty God, in order to build a just and humane society and establish a Government that shall embody our ideals and aspirations, promote the common good, conserve and develop our patrimony, and secure to ourselves and our posterity the blessings of independence and democracy under the rule of law and a regime of truth, justice, freedom, love, equality, and peace, do ordain and promulgate this Constitution.

ARTICLE I

National Territory

The national territory comprises the Philippine archipelago, with all the islands and waters embraced therein, and all other territories over which the Philippines has sovereignty or jurisdiction, consisting of its terrestrial, fluvial, and aerial domains, including its territorial sea, the seabed, the subsoil, the insular shelves, and other submarine areas. The waters around, between, and connecting the islands of the archipelago, regardless of their breadth and dimensions, form part of the internal waters of the Philippines.

ARTICLE II

Declaration of Principles and State Policies

Principles

SECTION 1. The Philippines is a democratic and republican State. Sovereignty resides in the people and all government authority emanates from them.

제1조 ①대한민국은 민주공화국이다. ②대한민국의 주권은 국민에게 있고, 모든 권력은 국민으로부터 나온다.

SECTION 2. The Philippines renounces war as an instrument of national policy, adopts the generally accepted principles of international law as part of the law of the land and adheres to the policy of peace, equality, justice, freedom, cooperation, and amity with all nations.

제5조 ①대한민국은 국제평화의 유지에 노력하고 침략적 전쟁을 부인한다.

SECTION 3. Civilian authority is, at all times, supreme over the military. The Armed Forces of the Philippines is the protector of the people and the State. Its goal is to secure the sovereignty of the State and the integrity of the national territory.

제 5조 ②국군은 국가의 안전보장과 국토방위의 신성한 의무를 수행함을 사명으로 하며, 그 정치적 중립성은 준수된다. (군사독재에 지친 두 나라의 모습....)

SECTION 4. The prime duty of the Government is to serve and protect the people. The Government may call upon the people to defend the State and, in the fulfillment thereof, all citizens may be required, under conditions provided by law, to render personal military or civil service.

SECTION 5. The maintenance of peace and order, the protection of life, liberty, and property, and the promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy.

(전체적으로 필리핀 헌법이 인민의 자유와 복지를 위한 국가의 의무를 더 강조한 느낌.)

SECTION 6. The separation of Church and State shall be inviolable.

State Policies

SECTION 7. The State shall pursue an independent foreign policy. In its relations with other states the paramount consideration shall be national sovereignty, territorial integrity, national interest, and the right to self-determination.

SECTION 8. The Philippines, consistent with the national interest, adopts and pursues a policy of freedom from nuclear weapons in its territory.

SECTION 9. The State shall promote a just and dynamic social order that will ensure the prosperity and independence of the nation and free the people from poverty through policies that provide adequate social services, promote full employment, a rising standard of living, and an improved quality of life for all.

SECTION 10. The State shall promote social justice in all phases of national development.

SECTION 11. The State values the dignity of every human person and guarantees full respect for human rights.

제2장 국민의 권리와 의무 
제10조 모든 국민은 인간으로서의 존엄과 가치를 가지며, 행복을 추구할 권리를 가진다. 국가는 개인이 가지는 불가침의 기본적 인권을 확인하고 이를 보장할 의무를 진다.

SECTION 12. The State recognizes the sanctity of family life and shall protect and strengthen the family as a basic autonomous social institution. It shall equally protect the life of the mother and the life of the unborn from conception. The natural and primary right and duty of parents in the rearing of the youth for civic efficiency and the development of moral character shall receive the support of the Government.

SECTION 13. The State recognizes the vital role of the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being. It shall inculcate in the youth patriotism and nationalism, and encourage their involvement in public and civic affairs.

SECTION 14. The State recognizes the role of women in nation-building, and shall ensure the fundamental equality before the law of women and men.

SECTION 15. The State shall protect and promote the right to health of the people and instill health consciousness among them.

SECTION 16. The State shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature.

SECTION 17. The State shall give priority to education, science and technology, arts, culture, and sports to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development.

SECTION 18. The State affirms labor as a primary social economic force. It shall protect the rights of workers and promote their welfare.

SECTION 19. The State shall develop a self-reliant and independent national economy effectively controlled by Filipinos.

SECTION 20. The State recognizes the indispensable role of the private sector, encourages private enterprise, and provides incentives to needed investments.

SECTION 21. The State shall promote comprehensive rural development and agrarian reform.

SECTION 22. The State recognizes and promotes the rights of indigenous cultural communities within the framework of national unity and development.

SECTION 23. The State shall encourage non-governmental, community-based, or sectoral organizations that promote the welfare of the nation.

SECTION 24. The State recognizes the vital role of communication and information in nation-building.

SECTION 25. The State shall ensure the autonomy of local governments.

SECTION 26. The State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be defined by law.

SECTION 27. The State shall maintain honesty and integrity in the public service and take positive and effective measures against graft and corruption.

SECTION 28. Subject to reasonable conditions prescribed by law, the State adopts and implements a policy of full public disclosure of all its transactions involving public interest.

한국 헌법은 2장 '국민의 권리와 의무'에서 국민들이 누려야 할 것을 적었는데, 필리핀 헌법은 내용이 비슷하면서도 그런 권리를 보장해줄 주체로 '국가'를 명시하고 있네.


한국 헌법도 비슷하긴 하다. 


제34조 

①모든 국민은 인간다운 생활을 할 권리를 가진다. 

②국가는 사회보장·사회복지의 증진에 노력할 의무를 진다. 

③국가는 여자의 복지와 권익의 향상을 위하여 노력하여야 한다. 

④국가는 노인과 청소년의 복지향상을 위한 정책을 실시할 의무를 진다. 

⑤신체장애자 및 질병·노령 기타의 사유로 생활능력이 없는 국민은 법률이 정하는 바에 의하여 국가의 보호를 받는다. 

⑥국가는 재해를 예방하고 그 위험으로부터 국민을 보호하기 위하여 노력하여야 한다.


다만 필리핀 헌법은 핵무기로부터의 자유를 명시한 것, 한국 헌법에 '노인과 청소년'만 거론된 것과 달리 '청소년' 뒤에 '여성'의 동등한 권리를 못박아놓은 것이 눈에 띔.


필리핀의 이 헌법이 만들어진 것은 피플파워 혁명이 일어난 1986년이었고, 이듬해 2월 2일 발효됐다. 이 헌법이 나오기 전에 필리핀에는 세 차례의 현대적인 헌법이 있었다. 1935년 것은 '연방헌법'이라 불렸고, 1973년 것은 그냥 연도를 따서 '1973 헌법'이라고들 불렀다. 이 헌법은 만들어지는 과정부터 전두환 체제의 헌법과 아주 유사했다. 원래는 1971년 제헌의회가 소집돼 새 헌법을 만들려고 했는데 독재자 마르코스가 1972년 9월에 계엄령을 선포하고 제헌의원들을 잡아들였다. 


그 후에 마르코스 입맛대로 만들어진 게 1973 헌법이다. 마르코스는 대통령령으로 제헌의회를 해산하고 새 헌법을 만든 뒤 그해 1월 10~15일 국민투표에 부쳤다. 그러고는 '시민 의회' 비슷한 것을 만들어서(체육관 선거로 전두환을 대통령으로 뽑은 통일주체국민회의 비슷한 것) 새 헌법을 비준하게 했다. 그리고 이틀 뒤에 헌법을 선포했다.


마르코스는 '노란 물결' 속에 쫓겨났고 지금의 헌법이 탄생했다. 필리핀 사람들이 '자유 헌법'이라 부르는 것이다. 


이 헌법을 만들기 위한 제헌위원회는 코라손 아키노 당시 대통령이 임명한 50명의 위원으로 구성됐는데, 그 중엔 정치인도 있었고 법률가도 있었고 마르코스에 맞서 싸웠던 인권활동가들도 있었다. 그리고 필리핀의 특성상 로마가톨릭 주교들도 참석했다. 그래서 민주주의와 인권과 '가족'을 동시에 강조하는 내용이 돼 버렸음. 그덕에 사형제 폐지가 명시되기도 했고. 


두 나라 헌법을 보니 재미있다.
